N.C. House passes Border Protection Act

Last night, in a party line 60 – 46, the North Carolina passed SB 153 North Carolina Border Protection Act. This legislation now heads back to the North Carolina Senate to consider the changes the House made and then over to the Governor’s Desk. Governor Stein has not indicated whether he will sign or veto the legislation.

Here is what the legislation does:

  • The legislation requires state law enforcement agencies like the Department of Public Safety and the Commander of the State Highway Patrol to cooperate with U.S. Immigration and Customs Enforcement (ICE).

  • It requires the Department of Health and Human Services, Department of Commerce, and Housing Finance Agency, and all local housing authorities to cease funding benefits for noncitizens residing in the United state with legal authorization.

  • Requires the Department of Commerce and Division of Employment Security to implement policies to verify that all applications are legally authorized to resided in the United States.

  • The legislation waives governmental immunity from tort liability for cities and counties that adopt sanctuary ordinances.

  • Prohibits the University of North Carolina system from having policies that limit federal law enforcement ability to enforce federal immigration laws.

House Republican go on offense:

After the vote, the North Carolina House Republican Caucus launched a digital ad effort to hold vulnerable House Democrats accountable for their votes this session. The ads will hit swing districts across North Carolina highlighting how their representative voted to prioritize illegal aliens over North Carolinians.

Here are the ads:

What They Are Saying:

  • Speaker Destin Hall said, “The House just passed the NC Border Protection Act requiring state law enforcement to cooperate with ICE. It’s commons sense: Law enforcement should enforce the Law.”

  • Majority Leader Brenden Jones said, “NC Democrats filed HB78 to ban NC law enforcement from working with ICE in schools. This mirrors Biden’s “no-go zones” policy—where ICE couldn’t enter places like daycares. The result? In Massachusetts, a convicted child rapist (an illegal alien) was just found living in a daycare. HB78 doesn’t protect kids. It protects criminals. North Carolina must reject this insanity.”

  • N.C. House Democratic Party House Caucus said, “To be clear, every one of them voted for immigration enforcement in the bipartisan House budget that you authored. Here’s a bold idea: pass the budget. Stop distracting from your failure to govern.”
