North Carolina Court Of Appeals Upholds Law That Authorizes State Auditor To Appoint Election Board

Today, the North Carolina Court of Appeals released a decision that upheld legislation that authorized the State Auditor’s to appoint the North Carolina Board of Elections. Previously the Governor made the appointments, but after the 2024 election the General Assembly moved the authority to the State Auditor. The impact is that the partisan shift on the State Board shifted from Democrat controlled to Republican.  

State Auditor Dave Boliek released the following statement on the North Carolina Court of Appeals ruling upholding the transfer of election board appointments to the State Auditor's Office: 

"Today's ruling affirms the constitutional independence of the State Auditor's Office. As part of the executive branch of North Carolina, we will continue to uphold the election duties prescribed to our office. Our goal remains to ensure elections in North Carolina are run impartially, effectively, and securely, and that all eligible voters have access to the voting booth. I have confidence in the State Board of Elections and our local boards of elections."
